MACP Clarification with some illustrations

P1010085Modified Assured Career Progression Scheme (MACPS)

MACP clarifications is given with useful illustrations for Defence Civilian Employees. This type of explanations is very useful to know and clarify the doubts of the new scheme. Wittingly to clear in the particular subject, because it is connecting with lifetime promotion of every employee.

This scheme for career upgradations to Central Govt. employees was introduced with effect from 1-09-2008 with introduction of revised pay rules 2008.

This scheme has replaced earlier scheme of Assured Career Progression Scheme of August 1999.

Under this scheme, an employee would get at least three career upgradations during his entire service on completion of 10,20 and 30 years of service.

Under this scheme an employee would be placed in next higher grade pay on completion of 10 years in previous grade and in case of no promotion has been offered to him.

 

 

a. Illustrations of Grant of MACP

Illustration – 1

In case of recruitment of an individual in Grade Pay (GP) of Rs.4200 with no promotion for 10 years,

1st financial upgradation after 10 years with GP-Rs.4600;
2nd financial upgradation after (10+10) 20 years with GP- Rs.4800;
3rd financial upgradation after (10+10+10) 30 years with GP- Rs.5400.

In case of recruitment of an individual in Grade Pay (GP) of Rs.4200 with first promotion after 5 years with GP of Rs. 4600,

The promotion will be considered as 1st financial upgradation;
2nd financial Up gradation after (5+10) 15 years with GP-Rs.4800;
3rd financial up-gradation after (5+10+10) 25 years with GP-Rs.5400.

In case of recruitment of an individual in Grade Pay (GP) of Rs.4200 with 1st promotion in 5 years with GP-Rs.4600 and 2nd promotion after 8 years,(5+8=13 years) with GP of Rs.4800,

He will get only 3rd financial up-gradation after (5+8+10) 23 years with GP-Rs.5400.

 

b. Norms for grant of MACP

The financial up gradation would be on non-functional basis subject to fitness in the hierarchy of pay band and grade pay.

The only benchmark of "Good" would be applicable till the grade pay of Rs.6600 in PB-3.

The benchmark will be "Very Good" for financial upgradation to the grade pay of Rs.7600 and above.

However, if the financial upgradation under the MACPS also happen to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS as mentioned in Para 17 of the scheme, the benchmark for promotion shall apply to MACP also.

 

c. Clarifications on MACP

If the promotional hierarchy as per recruitment rules is such that promotions are earned in the same grade pay, then the same shall be counted for the purposes of MACP.

Only the continuous regular service is counted towards qualifying service and the regular service shall commence from the date of joining in direct entry grade on the MACP envisages merely placement in the immediate next higher grade pay as given in Section1, Part A of first schedule of the CCS (Revised Pay) Rules 2008.

Financial upgradation will also be admissible whenever a person has spent 10 years in the same grade pay.

Only regular service rendered in the Central Govt. Department/Office would be counted for the purposes of grant of MACP.

All tenures spent on deputation, Foreign Service, study leave, all kind of leave, shall be included in the regular service.

 

d. The benefits of MACP are admissible upto HAG scale of Rs. 67000-79000.

All cases of grant of promotions/ACPs under pre-revised pay scales of Rs. 5000-8000, Rs. 5500-9000, Rs. 6500-10500 and Rs. 7400-11500 and if those  merged w.e.f. 1-1-2006 would be ignored for purpose of grant of financial upgradation under the scheme.

    R/Sir, Kindly guide me, shall I be eligible for getting of MACP of Rs.4600/- in July’2012 under the following circumstances: 1) July’1991 – appointed as Lab ‘B’ – Pay Rs.750/- in Ordnance Factory Bhusawal
    2) January’1995 – became LDC – Pay-Rs.950/- through LDCE exam.
    3) July’1997 – became Stenographer-III – Pay Rs.1200/- ( Revised Rs.4000/- as per V CPC) through LDCE Exam.
    4) July 2002 – promoted as PA-II -Pay Rs.5000/- through regular promotion.
    Sir, I will be competing 10 years service in PA (GP-4200/-) without any promotion during July’2002 to July’2012. Kindly guide me, whether I am eligible for getting MACP of Rs.4600/- in July’2012 or not and if not in july’2012, when I shall be eligible for getting MACP of Rs.4600/-

      In pursuance to the instructions contained in O.M. No. 35034/3/2008 Dated 19.05.2009 issued by the Government of India, Ministry of Personnel, Public Grievances and Pensions, New Delhi and on the basis of recommendations of the Screening Committee, (Group ‘C’), the Competent Authority, has been pleased to grant me 1st Financial Up-gradations under Modified Assured Carrier Progressive Scheme (MACP) in Pay Scale of PB-1 Rs. 5200 – 20200, Grade Pay Rs 2800, with effect from 15.04.2010.

      In this regard, as against the said Order Dated 17.10.2011 I am to submit as below:-
      [1] That I was appointed as Lower Division Clerk in the U.T Administration of DNH and I had resumed my duties as LDC w. e. f 01st August, 1988 in the Pay Scale of Rs. 950-20-1150-EB-25-1500 – IVth CPC, Pre-revised to Rs. 3050-75-3950-80-4590 in Vth CPC and Pre-revised to PB-1, Rs 5200-20200 + Grade Pay of Rs. 1900 in VIth CPC.

      [2] On the recommendations of the Department Promotion Committee, as approved by the Appointing Authority, I was promoted to the post of Stenographer, Grade-III, vide Order Dated 15.02.2000 against the existing vacancy, after going through the Skill Test, as per the provisions of Recruitment Rules for filling up the vacant post of Stenographer, Grade-III by Promotion in the Pay Scale of Rs. 4000-100-6000 Pre-revised to PB-1, Rs. 5200-20200 + Grade Pay of Rs 2400 in VIth CPC.

      [3] I had resumed my duties as Stenographer, Grade-III on 15.04.2000 to the place of posting on being relieved from the concerned Office and post of LDC.

      [4] The following Grades and its Pay Structure for the posts of Stenographers have been made applicable in the UT Administration of Dadra & Nagar Haveli:-

      a. Stenographer, Grade – III.
      Rs. 4000-100-6000 Post Grade : S-7, Vth CPC.
      Pre-revised : Rs. 5200-20200, Pay Band-2,
      Grade Pay Rs. 2400.

      b. Stenographer, Grade – II.
      Rs. 5000-150-8000 Post Grade : S-9, Vth CPC.
      Pre-revised. Rs. 9300-34800, Pay Band-2,
      Grade Pay Rs. 4200 and

      c. Stenographer, Grade – I.
      Rs. 5500-175-9000 Post Grade : S-10, Vth CPC.

      [5] In support of my grievances, I hereby respectfully place my reliance on Clarification against the Query, issued vide Letter No. A-26017/76/2009-Ad.IIA Dated 29.09.2009 of the Under Secretary to the Government of India, Ministry of Finance, Department of Revenue, Central Board of Excise & Customs, New Delhi circulated vide Letter No. A-26017/76/2009-Ad.IIA Dated 02.02.2010 by the concerned Ministry. The relevant portion is reproduced below.

      Sr. No. Query Clarification

      4 The UDCs (Rs. 4000-100-6000) were promoted to the grades of DOS Level-II (Rs. 5000-150-8000), DOS Level-1 (Rs. 5500-175-9000), Office Superintendent (Rs. 6500-200-10500) and Administrative Officer Group ‘B’ (Rs. 6500-200-10500) in terms of Recruitment Rules. Now the pay scales of Rs. 5000-8000, 5500-9000 and 6500-200-10500 have been merged in the Pay Band -2, Rs. 9300-34800 with Grade Pay of Rs. 4200. It may kindly be clarified whether the promotions in the pay scales of Rs. 5500-9000 & Rs. 6500-10500 are to be ignored in terms of Para 5 of Annexure – I of DOPTs O.M. Dated 19.05.2009 or shall be counted for the purpose of MACPS as per Para – 8 ibid.

      It is clarified that such situation is required to be dealt in accordance with Para 5 of the Annexure-I of the MACP scheme Dated 19.05.2009.

      [6] The Para 5 of the Annexure-I of the MACP scheme O.M. No. 35034/3/2008-Estt.(D) Dated 19.05.2009 issued by the Deputy Secretary, Government of India, Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), New Delhi. The relevant portion is reproduced below.

      Para. 5 : Promotions earned / upgradations granted under the ACP Scheme in the past to those grades which now carry the same grade pay due to merger of pay scales / upgradations of posts recommended by the Sixth Pay Commission shall be ignored for the purpose of granting upgradations under Modified ACPS.

      Illustration – I.

      The pre-revised hierarchy (in ascending order) in a particular organization was as under: –

      Rs. 5000-8000, Rs. 5500-9000 & Rs. 6500-10500.

      (a) A Government servant who was recruited in the hierarchy in the pre-revised pay scale of Rs. 5000-8000 and who did not get a promotion even after 25 years of service prior to 1.1.2006 in his case as on 1.1.2006 he would have got two financial upgradations under ACP to the next grades in the hierarchy of his organization, i.e, to the pre-revised scales of Rs. 5000-9000 and Rs. 6500-10500.

      (b) Another Government servant recruited in the same hierarchy in the pre-revised scale of Rs. 5000-8000 has also completed about 25 years of service, but he got two promotions to the next higher grades of Rs. 5000-9000 & Rs. 6500-10500 during this period.

      In the case of both (a) and (b), the promotions / financial upgradations granted under ACP to the pre-revised scales of Rs. 5500-9000 and Rs. 6500-10500 prior to 1.1.2006 will be ignored on account of merger of the pre-revised scales of Rs. 5000-8000, Rs. 5500-9000 and ` 6500-10500 recommended by the Sixth CPC. As per CCS (RP) Rules, both of them will be granted Grade Pay of Rs. 4200/- in the Pay Band – 2. After the implementation of MACPS, two financial upgradations will be granted both in the case of (a) and (b) above to the next higher Grade Pays of Rs. 4600 and Rs. 4800 in the Pay Band – 2.

      [7] In terms of Para 5 of MACPS “Promotions earned / upgradations granted under the ACP Scheme in the past to those grades which now carry the same grade pay due to merger of pay scales / upgradations of posts recommended by the Sixth Pay Commission shall be ignored for the purpose of granting upgradations under Modified ACPS, the Pay Scales of Rs. 5000 – 8000, Rs. 5500 – 9000 and Rs. 6500 – 10500 have been covered by this provisions vide O.M. No. A. 26011 / 20 / ACP / 2009 /MF. CGA (A )/ NGE / 343 Dated 10.06.2009.

      [8] The point of doubt whether the Pay Band would change in the hierarchy of Pay Bands & Grade Pay on grant of benefits under MACPS? The answer is YES, as per the Clarification given vide O. M. No. 35034/3/2008-Estt(D) Dated 09.09.2010 by referring the O.M of Even No. and Dated 07.09.2010 by the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel & Training, Establishment (D), New Delhi.
      [9] And as envisaged the Upgradations under MACPS is to be granted in the immediate next higher grade pay in the hierarchy of recommended Revised Pay Band and Grade Pay as prescribed in the CCS (RP) Rules, 2008.

      [10] In this regard, I am to respectfully reproduce the Pay Structures and hierarchy of 5th CPC and 6th CPC, as applicable to the Stenographers of this UT Administration.

      [14] The Officiating Promotion had been granted to me as against the vacant post of Stenographer, Grade-III. The benefits of the ACP Schemes as implemented during the 5th CPC were not granted to me on account of Officiating Promotion to the post of Stenographer, Grade-III prior to completion of 12 years of regular service in the Cadre of LDC.

      [15] On account of Officiating Promotion my Cadre has been changed from LDC to the Cadre of Stenographers. The Pay Structures of Ugradations / Promotion hierarchy of the Post of LDC and Stenographer, as per 5th CPC and 6th CPC are different.

      [16] I have completed more than 11 years of Regular Service on the Post of Stenographer, Grade-III. No Upgradations / Promotion has been granted till date, except the 1st Financial Upgradation under MACP vide Order Dated 17.10.2011.

      [17] I have completed more than 23 years of Regular Service from the date of my resuming of duties as LDC and Officiating Promotion as Stenographer, Grade-III, in this U.T Administration.

      [18] The Grade Pay of Rs. 2800/- made admissible under 1st Financial Upgradation in MACP Scheme vide Order Dated 17.10.2011 is not within the structure of Grade Pay and Pay Structures of Upgradations/Promotions to the Post of Stenographer of the UT Administration.

      19] It’s a Non Secretariat Organization.

      In view of the facts as stated above, it is most respectfully prayed to to kindly advice as to whether I am eligible for revision of the Grade Pay from Rs. 2800 to Rs. 4200/- with the directions of Re-fixation of Pay w.e.f 01.09.2008 and arrears, as I have completed 20 Years of regular service in the UT Administration. If yes, the grounds to move the Revision Application may kindly be intimated.

    Question:- In this case can I eligible for MACP next GP Rs. 4600/- after promotion. Or completion of Ten Years service in same grade Pay Rs. 4200 Yes/No. Or other benefit on promotion?

    Sir,
    I have completed 30 years of service and am a class B officer drawing a grade pay of Rs 6600/- It is stated that the bench mark for the next grade pay of Rs 7600/- must be VERY GOOD FOR 5 YEARS in order to get 3rd maps. Now the problem is before 31/8/2008 the 3 CR’s were only GOOD given by the controlling officer and agreed by reviewing officer and the 2 CR’s were VERY GOOD after 31/8/2008. Should not I be given the 3rd maps after completion of 30 Years. Please clarify that the bench march before the 31/8/2008 was only GOOD and the Department has considered all for 5 years VERY GOOD and denieed the MAPS to me. Is there any clarafications in this respect where it will help me th get the MAPS.

    I) I, enrolled in SSB Department on 27.09.74 for the post of Constable (GD) in the pay Scale of Rs. 85-2-95-3-110 (Now Grade Pay Rs. 2000/-)

    ii) On 07.02.92 , I Join the duty in same department for the post of SFA(Vet) in the pay scale of Rs.975-25-1150-30-1660 (now Grade pay Rs.2000/-) from pay scale of Rs.950-20-1150-25-1400 (Now Grade Pay Rs.2000/- ) on transfer basis after tendering technical resignation.

    III) After receipt the report of 6th pay Commission my scale has been merged in the grade of Constable (GD) & my grade Pay started from Rs. 2000/- which is equal to Constable (GD) in the department I am also initially enrolled Constable (GD) in the department & Join the duty for the post of SFA Vet) on 07.02.92 from Const/LNK (GD) on transfer Basis after tendering technical resignation after completion 17 years service in rank of Const/L/NK(GD) (in one Scale)

    1) date of appointment 5.5.1992 in Gr. 950-1500 (Jr, Clerk)
    2) Change of cadre as Steno – 19.1.93 Gr. 1200-2040
    3) Promoted as Sr. Steno on 9.8.1997(Rs. 5000-8000)
    4) Regularized in above grade on 10.2.2003
    5) Promoted as Sr. Steno on 9.8.2007 ( 5500-9000)
    6) Pay Scales 5000-8000 and 5500-9000 merged in 6th Pay Commission.
    I have put in continuous service in the same grade since 1997. Am I eligible for MACP from 2007 or from 2013? Kindly guide. A reply will be highly appreciated.

    I submit my request as under,
    1. Appointed as S.O.M Gd.Rs.1400-2300 vide RRB/CDG & Joined as apprentice SOM in pay scale Rs.1400-2300 on 01.02.1990.
    2. Joined as regular SOM in pay scale Rs.1400-2300 on 05.03.1991.
    3. As per 5th CPC fixed in pay scale Rs.4500-7000+100 w.e.f. 01.01.1996. as SOM.
    4. After completion of 12 Years regular service under ACP fixed pay scale Rs.5000-8000 w.e.f. 05.03.2003 as SOM.
    5. Due to merging of posts of (SOM) Supervisor/works Gd.Rs.4500+7000+100 in the cadre of JE/II/Works Gd. Rs.5000-8000 w.e.f. 01.11.2003 again fixed in pay scale 5000-8000 as JE/II/Works.
    6. As per 6th CPC fixed in PB-II Rs.9300-34800-4200 w.e.f. 01.01.2006. as JE/II/Works.
    7. Ist MACP given and fixed in PB-II Rs.9300-34800-4600 w.e.f. 01.09.2008.
    Sir, I want to know that I am due or not for the benefit of IInd MACP in PB-II 9300-34800-4800 w.e.f. 05.03.2011.

    Subject Fixation of pay,
    Respected sir,
    I would like to inform you that I was appointed in 425 scale (5000-8000) as Draftsman grade-II (permanent) by the Direct recruitment process and after that I was promoted as draftsman Grade-I on 10-06-1993 in the pay scale of 5500-9000. On 1-1-2006 after more than 23 years service I had not given any benefit of promotion and my pay was fixed in grade pay 4200. Which is unjustified? After 24 years service on dated 30-08-2006 under( ACPS) my pay was fixed in the grade pay 4600.
    After that on 1-09-2008 Under (MACPS ) 2nd Upgradation my pay was fixed in grade pay 4800.
    On 17-09-2008 I was promoted as Head Draftsman (which is Group B Gazetted Post with higher responsibilities) without given any increment or grade pay.
    Sir as per DOPT (FAQs) of dated 28-08-2012 I hope my pay may be refixed .kindly help me in fixing of my pay as early as possible.

    My Date of joining in PSU 12.02.1997 as a trainee tech scale 3050..
    Got first promotion on 01.07.2002 as a Tech II..
    In 01.04.2004 Organisation management technically changed from PSU to DRDO Society.
    In 2008 for VI pay implication management exercised, Scales fixed As per V cpc of with effective date 31.12.2006.
    That IDA scales taken for CDA from 01.01.2007.(Sixth pay Effective date)
    Last promoted in 01.07.2002. When is My promotion Due.
    On that Date (31.12.2006) Actually my Basic on the day Rs.4425. As per IDA) (Designation) Technician II .
    I called DPC and get Promotion in 01.01.2008.
    But my pay was not changed.
    Is it correct. If not How will be the my Pay and Grade Pay ?
    Please give the clear picture on this.

    2Due to cadre resturcture in year 2008 , Promotion is given to scale G.P. 4800.
    3.Before cadre restructure:- 5500-9000 next 6500-10500 next 8000-13500
    4.After cadre restructure:- GP-4800 next GP 5400 next GP 6600
    Question:- In this case can I eligible for MACP in year 2014 as in cadre review 5500-9000 abolished and promotions given in year 2008 will be ignored?

    Sir,
    I am a direct recruit Assistant since June 29, 1974. I was promoted as Section Officer in 1991. After completion of 24 years of service I was granted 2nd ACP in the pay scale of Rs.10,000-Rs.15,600 (Now PB-3 with a grade pay of Rs.6,600/-) with effect from 9.8.1999. I did not derive any benefit (notional or actual) from NFS which was introduced with effect from 03.10.2003, in which SOs with 4 years of service got pay scale of Rs.8,000-Rs.13,500. Hence, NFS is not applicable to me as I was drawing a higher pay (Rs.10,000/-) in a higher pay scale (Rs.10,000-Rs.15,600) from an earlier date (9.8.1999). Please confirm that I am eligible for 3rd MACP, effective from 01.09.2008, in the PB-3 of Rs.15,600-Rs.39,100 with a grade pay of Rs.7,600/- in terms of DOPT’s circular No.35034/3/2008-Estt.(D) dated 9.9.2010.     I have joined as Inspector on 22.03.1993.

    I have receved 1st ACP on 01.04.2007.

    I have completed 20 years of service in the same grade on 21.03.2013.
    When am I due for IInd MACP

    i was working in railway from 12.09 2005.GP-(4200) .Then after technical resignation from railway (Proper Channel) i join in central excise deparment on 15.1.2013 GP-(4600). My regular increment date 1.7.2013. Will i get next increment in central excise department on 1.07.2013.

    RESPECTED SIR, I WANT TO INFORM U THAT I HAVE QUALIFIED DEPARTMENTAL EXAM AS UDC , AND MY PAY WAS FIXED ON 16/06/2010, WITH NEXT INCREMENT IN JULY 2011. LATER IN NOVMBER I GOT MACP ORDER W.E.F. FROM 24/04/2010. LATER MY PAY WAS FIXED AS PER MACP ORDER , AND MY BASIC PAY REDUCE UPTO 250/- . SAYING THAT NO FIXATION ALLOWED WITHIN 6 MONTHS , DUE TO MACP I BEAR A LOT OF LOSS OF MONEY,PLEASE CLARIFY HOW TO FIX MAY PAY, OR AM I HAVE RIGHT TO FORGO MACP. AND WHAT EFFECT MY FUTURE MACP .

    I have joined as LDC on 10.07.1997 (ICAR). I have received 1st MACP on 01.09.2008. thereafter, i promoted as UDC on 06.02.2013 after promotion i have granted the difference of grade pay between Rs. 2000 and Rs. 2400. No additional increment win be granted at this stage.
    Kindly guide me, whether I am eligible for getting normal increment in July 2013 or not.

    I am working in Accounts Section of my office. One employee of my office appointed as LDC (pre revised sc.3050-4590 5th CPC) on 25.03.1982 and got promotion to UDC(scale 4000-7000 5th CPC) on 04.03.1992 subsequently he promoted to the post of Assistant on 01.04.2004 (pre-revised scale 5000-8000/revised PB-2, 9300-34800 GP-4200/-) and he got promotion to the post of Office Superintendent on 27.12.2010 (pre-revised scale 5500-9000/- / revised Pay Band-2, 9300-34800 GP-4200/-). Now the individual applied for 3rd MACP. Whether he is entitled for 3rd MACP since the pre-revised scale of 5000-8000 and 5500-9000/- is marge with 6500-10500 / revised PB-2 9300-34800, GP-4200/- and the above mentioned last two promotional post are carrying same Pay Band and Grade pay. If so, what grade pay will be allowed?
