OFFICE MEMORANDUM

Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers’ Grade man their juniors – OM No.18/2/2007-CS-I dated 20.05.2014 – Followup action regarding.

The undersigned is directed to refer to this Departments OM No.18/2/2007-CS-I dated 20.05.2014 and subsequent clarifications issued vide OM dated 08.07.2014 on the subject mentioned above.

2. The Ministries/Departments were requested vide OM dated 20.05.14 that stepping up of pay already allowed in cases where the individuals are not covered by the OMs dated 13.04 1988, 23.02 1994 and 08.10.1996 and where conditions laid down in the OM dated 04.11.1993 are also not fulfilled, may be reviewed and pay re-fixed accordingly. They were further requested that the excess payments made to the employees in the cases of wrong stepping up of pay may be recovered in terms of DOP&Ts OM No.18/26/201 1-Estt(Pay-I)
dated 06.02.2014 and a compliance report in this regard furnished to this Department by 31.08.2014. However the compliance reports are still awaited from the Ministries/Departments.

4. The Ministries/Departments are once again requested to furnish the compliance report in this regard immediately.

Sir,

This is regarding stepping of pay of promotee senior with reference to direct recruited junior appointed after 01.01.2006.

1. The issue was examined in this office and referred to Ministry of HRD for clarification. Ministry of HRD vide letter No.F.3-43/2008/UT.2 dated 20th March 2009 has clarified that the stepping up of pay of the promotee senior with direct recruited junior appointed on or after 01.01.2006 may be agreed to subject to fulfillment of the following conditions:

(a) Stepping up the basic pay of seniors under the above provision can be claimed only in the case of those cadres which have an element of direct recruitment and In cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basis pay of the seniors will be stepped up with reference to the basic pay of the junior.

(b) Using the above provision, Government servants cannot claim stepping up their revised basic py with reference to entry pay in the revised pay structure for direct recruits appointed on or after 1.1.2006 as laid down in Section II of Part A of First Schedule to the CCS (RP) Rules, 2008, if their cadre does not have an element of direct recruitment, or in cases were no junior is drawing basic pay higher than them.

(C) Stepping up of pay of the seniors in accordance with the above provision shall not be applicable in cases where direct recruits have been granted advance increments at the time of recruitment.

The issues prevailing in the region may be decided as per above clarifications.

Stepping up of pay of Personal Assistants of CSSS in case of ACP

Stepping Up -Stepping up of pay of Personal Assistants of CSSS in case of ACP followed by ad-hoc promotion.

The Department of Personnel and Training has intimated through an office memorandum, which is published on 19th April 2012 in its website regarding that the stepping up of pay for Personal Assistants of Central Secretariat Stenographers Service. In case of financial upgradation through ACP followed by ad-hoc promotion, the department once again consulted with the Finance Ministry on the above subject. The Department of Expenditure has conveyed their advice through a Note I.D. No.18/11/2010-Legal (Pt.File)-Vol.I dated 10.4.2012.

The terms and conditions are…

"the senior PAs of CSSS who have attained ACP/ad-hoc/regular promotion prior to 1.1.2006 and are drawing less pay than PAs of CSSS who have been granted ACP/ad-hoc/regular promotion after 1.1.2006 (i.e. between 1.1.2006 and 31.8.2008) may be permitted stepping up of pay subject to the fulfilment of the following conditions:

(i) Both the junior and the senior Government servants should belong to the same cadre and the posts in which they have been promoted/financially upgraded should be identical in the same cadre.

(ii) The pre-revised scale of pay and the revised grade pay of the lower and higher posts in which they are entitled to draw pay should be identical.

(iii) The senior Government servants should have been drawing equal or more pay than the junior before receiving ACP/ad-hoc promotion.

(iv) The stipulations as contained in DOPT’s O.M. No.4/7/92-Estt.(Pay-I) dated 4.11.1993 along with revision of pay scales may be observed while granting such a stepping up of pay.”

The other terms and conditions mentioned in the ibid O.M. dated 25.1.2012 will remain unchanged.

Subject :: Applicability of minimum pay/stepping up of pay — clarification — reg.

Sir,

A number of references have been received in this Office regarding applicability for departmental promotes, of minimum entry pay prescribed for direct  recruits (appointed on or after 1.1.2006) in Section II of Part A of the First Schedule of  CCS (RP) Rules 2008. References have also been received regarding stepping up of pay of senior promote Inspectors/similarly placed Officers in the field formations under CBEC with reference to such of their directly recruited juniors who are recruited on or  after 1.1.2006 and whose basic pay is more than that of their seniors appointed on or after 01.01.2006.

2. The matter was examined by this Department in consultation with the Department of Expenditure. The proposal relating to stepping up of pay of senior promote Inspectors/Similarly placed Officers in the field formations under CBEC with  reference to such of their directly recruited juniors appointed on or after 1.1.2006 is agreed to subject to fulfillment of the following conditions:

(a) stepping up of the basic pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the basic pay of the directly recruited junior provided they belong to the same seniority list for all purposes.

(b) Further, Government servants cannot claim stepping up of their revised basic  pay with reference to entry pay in the revised pay structure for direct recruits appointed on or after 1.1.2006 as laid down in Section II of Part A of First schedule to CCS (RP) Rules 2008, if their cadre does not have an element of  direct recruitment or in cases where no junior is drawing basic pay higher than them.

(c) Stepping up of pay of the seniors shall not be applicable in cases where pay of  direct recruits have been granted advance increments at the time of recruitment.

3. Clarification relating to manner of pay fixation of Inspection / similarly placed officials under CBEC consequent upon grant of revised pay structure of the grade pay of Rs. 4600 in PB 2, drawing reference from DoP&T O.M. No.7/7/2008-CS.I(A) dated 22.12.2010 and 18.3.2011 will be issued separately in consultation with the Department of Expenditure / Department of personnel and Training.

4. This issues with the concurrence of the Ministry of Finance, Department of Expenditure UO Nos. 579/E.III-A/2011 dated 18.10.2011 and 23.01.2012.
